  • Bodily injury liability car insurance coverage pays for medical bills, rehabilitation costs and lost wages for people who have been injured in a motor vehicle accident. The bodily injury liability coverage also pays for funeral costs if the accident results in one or more fatalities.
  • Property damage coverage pays to repair the other driver’s vehicle, as well as any public property that was damaged in the accident, including mailboxes, signs, and fences.
  • The minimum level of bodily injury liability coverage required under South Dakota law is $25,000 for one person’s injuries and $50,000 to pay for damages incurred by everyone hurt in an accident, no matter how many victims were involved. At least $25,000 in property damage coverage must be purchased as well.

Drivers must buy the minimum level of coverage to stay “legal” in South Dakota. They can buy a higher level of protection if they wish.

Given the fact that the costs of medical care and rehabilitation expenses will only continue to increase over time, it makes sense to consider buying a policy with a higher limit than the minimum level required under state law.

South Dakota drivers live in a tort state, which means that injured people have the right to sue to recover damages. The at-fault driver or his or her car insurance company is responsible for paying for these costs.

When an injured person is seeking to recover damages, the at-fault driver’s car insurance policy will pay, but only up to the policy limit the insured has selected.

If the policy limit is not high enough to adequately compensate the accident victim for his or her injuries, the at-fault driver is personally responsible for paying the difference.
