Jersey City Insurance Laws

It is illegal to drive in Jersey City without adequate proof of insurance.

If a police officer asks to see your insurance and you don’t have it, you could face fines of $300, a one-year license suspension, and an indeterminate amount of community service.

For a repeat offense, you may be liable for a fine of $500, a two-year license suspension, 14 days in jail and 30 days of community service.

Insurance laws in the state of New Jersey are peculiar compared to other states for several reasons:

  • New Jersey is a Choice No-Fault state, which means that drivers must choose whether they want to opt-in to a No-Fault policy program or whether they would rather have a fault-based Tort policy.
  • The state offers the option to self-insure if you have over 25 vehicles registered. This option is generally only used by businesses to help keep costs down.
  • Drivers in Jersey City may choose one of two auto policy plans depending on their financial and age status. The Basic Policy plan is geared toward young drivers with limited money. The Standard Policy plan is also a minimum insurance plan but is geared toward all other drivers.

What Is Choice No-Fault?

New Jersey is one of only three states that offers drivers the choice of a No-Fault plan or a Tort plan.

If your insurance company doesn’t offer you the choice, No-Fault is the default type of plan.

The main difference between the two plans is in how they mete out payments in the event of an accident.

A No-Fault plan will always pay for your damages and will never pay for another person’s damages.

A Tort plan will only pay for your damages if a court of law determines you to be at fault. In this case, your insurance provider will also pay for the other person’s damages.

Tort vs. No-Fault

There is no clear consensus on whether it is better to sign up for a Tort policy plan or a No-Fault plan. It is up to you to decide which you want to use.

– Reasons to Choose a Tort Plan

  • If you believe you will never be deemed to be at fault in an accident
  • If you don’t want your premium rates to be determined by whether someone else drives poorly and hits you

– Reasons to Choose a No-Fault Plan

  • If you want an overall cheaper plan
  • If you don’t want to deal with the hassle of court whenever you get into an accident
  • If you are concerned about uninsured/underinsured motorists hitting your vehicle

Jersey City Insurance Requirements

There are two sets of insurance requirements depending on whether you want a Basic or Standard policy. Basic insurance is bare-bones and is designed for people with very limited financial resources.

The basic insurance amount tends to be barely enough to cover injury costs for one person. fIf you are concerned about protecting your vehicle’s passengers, you will want to purchase a Standard insurance policy.

When you sign up for your insurance policy, your provider will always at least offer you the minimum requirements in the insurance category you choose. However, because Jersey City can be a rough town at times, you may want to sign up for extra insurance coverage.

The two most common extras are collision coverage and comprehensive coverage:

  • Collision coverage protects you from car accidents that are strictly your fault. Any altercation with an inanimate object requires collision coverage if you want the money to fix your car.
  • Comprehensive coverage protects you from theft, vandalism, and weather-related events. High crime rates in Jersey City make owning a car a liability without protection against theft.

Additionally, certain cars are greater targets for thieves or vandals. Depending on where you live or what you drive, purchasing comprehensive coverage for your insurance policy may be a prudent idea.
