Here's what you need to know...

  • Home care workers must commute to their patients’ homes every workday as a condition of employment
  • You should check with the home health care agency that you work with to see if you’re required to have high limits
  • If you drive patients to and from appointments as a service you’re paid for, you need commercial coverage
  • Your claims could be declined if you drive patients around and you’re paid for the service under your insurance
  • Make sure that you have high limits of liability that will help protect you if coverage is afforded under insurance

If you’re a home health care worker who offers health care services to patients of all ages, you play a special role in the medical care sector.

Your duties could include everything from monitoring a patient’s status and offering nutrition therapy to administering medications and educating patients. It’s a fulfilling job because you’re helping patients regain their independence at home.

Many people don’t even consider how their choice of occupation will affect their insurance portfolio. Not only could your rates be higher because of your profession, but your protection could also be compromised.

Find Out the Insurance Requirements Through Your Agency

It’s typical for firms that provide health care services to hire independent caregivers to go to their patients’ homes. The firm is the contact for the patient and the worker’s employer.

As you’re searching for the right agency or firm to seek employment through, you have to consider what the firm’s employment requirements are.

A driver’s license isn’t always a requirement for employment, but when your job is to go to and from different locations, having your license and a clean record will be a requirement.

You may also have to prove you have regular access to a vehicle and your own personal auto insurance with acceptable limits.

Why does the firm care how much insurance you have?

Whenever you’re driving from one job site to another job site, it creates a risk for the firm on a day-to-day basis.

The agency employing independent caregivers has a lot of auto exposures to manage and they must protect themselves so that they don’t go out of business after a single accident lawsuit.

During the hiring and the screening process, the firm will review your motor vehicle record, but the recruiter must also see your current auto insurance declarations page with your limits.

You’ll have to sign agreements acknowledging that you must carry high limits. Most contractors require at least to protect the firm from significant lawsuits:

  • $100,000 in bodily injury liability
  • $100,000 in property damage liability
  • $100,000 combined single limit

Do private caregivers need insurance?

You’re probably driving your personal vehicle to and from your patients’ homes.

Typically, you’d have personal auto coverage on a vehicle that you’re commuting in as long as you’re only driving the vehicle for incidental, non-commercial use. Unfortunately, some insurers define the duties of a home care worker differently than others.

You’ll have to determine if you need commercial coverage or if you’re still protected with the typical policy form. The answer depends on the provider you’re with and the personal auto policy contract form that’s used.

You’ll have to review the terms of your contract before you ever are convinced that you’re fully protected.

Do I need car insurance for transporting clients?

You always need to look at job descriptions before you ever accept an assignment as an employee of a health care firm.

There are agencies that provide strictly personal care aides in the home and then there are other agencies with more services that include driving patients to purchase goods or to doctor’s appointments.

What do most auto policy contracts say?

In your personal auto policy, it says that you can drive your personal car as a commuter vehicle and you can also use it for trips that are incidental to your business.

It gets a little complicated when you start to look for coverage if you’re driving others around in your vehicle as part of your professional duties. For example:

  • Under your personal auto policy, you can’t drive people around as a taxi service.
  • You can’t drive people around in your vehicle as a service that you’re being paid for.

Since part of your duties would be to drive patients to the doctor regularly, anything that happens while patients are in your car may be excluded because driving clients is a service you’re being paid for.

What happens if you’re not straightforward with your insurer? If you fail to mention that you’re driving your car around to fulfill your duties as a home care worker, you could face some serious issues when the time comes to file a claim.

When your usage is violating the terms of your contract, the insurer can refuse to pay for damages. That refusal could leave you paying for court costs, lawyers, and other expenses all on your own.

What types of insurance do personal care aides need to purchase?

If you’re going to be driving patients around as a caregiver, you will either need to get something in writing saying the agency will offer you auto liability protection or you’re going to have to buy a commercial auto policy.

A commercial auto policy may be a bit more expensive in terms of premiums, but it will offer you flexibility when it comes to protection.

Passengers in your car will have medical payment coverage and you can even select higher limits of liability. If you have a damage claim while you’re on business, you don’t have to worry about a refusal to pay for your repairs as long as you have the coverage.

Nursing home care workers can get several different discounts on personal auto insurance when they don’t transport patients.

You can save money for having a degree and you’ll already get lower rates because of your title in health care.
