The state of Alaska has decided to tackle the drunk driving problem by creating very strict DUI laws.

These laws are applicable once law enforcement officers can prove the blood alcohol content (BAC) in a driver’s system is at least .08. If this is the case, Alaska drivers are prohibited from sitting behind the wheel of a vehicle.

When stopped by law enforcement officers, Alaska residents have a choice of either submitting their blood, breath, or urine for the BAC test.

If they refuse to give any of these substances, the state will impose several consequences on them, even though they haven’t been convicted of a DUI.

Consequences for Refusing the BAC Test

  • The first refusal requires a three-month revocation of driver’s licenses
  • If there is one other conviction or refusal from the past, the revocation will last one year
  • Two other convictions or refusals result in a three-year revocation
  • A driver who has three prior convictions or three prior refusals receives a five-year revocation.

In determining the numbers of prior convictions or refusals a driver has, the state considers the convictions and refusals that occurred in other states as well as those in Alaska.

Alaska Drivers’ Licenses Will Be Revoked

Alaska has several other reasons that they will revoke a driver’s license that is related to a DUI conviction.

The BAC will have to be at least .08 or above. If the driver is conducting a commercial vehicle, his BAC only needs to be .04 to receive this penalty.

If drivers under the age of 21 are stopped on suspicion of driving under the influence, they will have their drivers’ licenses revoked in the event that:

  • They have had any alcohol whatsoever before driving
  • They refuse to give blood, breath, or urine for the chemical test
  • They have obtained their alcoholic beverages with a license that doesn’t belong to them or isn’t real

Penalties for DUI Convictions in Alaska

Those convicted for breaking Alaska’s DUI laws receive ever-increasing penalties if they continue to be taken to court for the same offense:

  • The First Time – they will have their licenses suspended for three months. They will have to spend three days in jail. They will also have to pay a $1,500 fine.
  • The Second Time – their licenses will be suspended for one year. They receive a jail sentence lasting 20 days. The fine they must pay is doubled to $3,000.
  • The Third Time – this is considered a Class C felony in Alaska. The driver’s license will be suspended for at least three years. They will receive a two-month jail sentence. The third conviction requires a $4,000 fine.
  • The Fourth Time – This creates another Class C felony and entitles these drivers to a five-year suspended license. They will have to spend three months in jail and pay a $5,000 fine.
  • The Fifth Time – Alaska drivers who have a fifth DUI conviction now have a third Class C felony on their records. Their drivers’ licenses will be suspended for at least five years, they will spend eight months in jail, and they will be ordered to pay a $6,000 fine.

Possible Additional Alaska DUI Penalties

Alaska also may add some other penalties in addition to those above.

The state may require that incarcerated drivers take medication that will keep them from drinking alcohol either while they are in jail or in order to be released on probation or parole.

If they are allowed to drive while they are on probation, they may be required to have the Ignition Interlock Device (IID) installed in their vehicles.

To qualify for probation or parole, they may need to agree to attend an alcohol rehabilitation program.

The Effect of a DUI on Alaska Insurance Rates

After an arrest for DUI, drivers will begin to see the effects in their auto insurance.

Their current auto insurance companies are going to be required to raise their rates, even if they haven’t been convicted of the DUI.

An arrest is enough to make them high-risk clients.

The auto insurance company may decide that it’s warranted to raise these people’s rates two times, three times and sometimes even four times what they were paying before the DUI arrest. These rates can be in effect for at least three years.

Certain Alaska Insurance Cancellations

If these drivers are insured with an insurance company that doesn’t have a high-risk division that they can move these clients to, they will have to cancel the policy or refuse to renew.

These individuals will have to then take on the daunting task of finding another insurance company to insure them with a DUI on their records.

Lowering Insurance Rates with Time

The increase in auto insurance rates after a DUI can be as much as $4,500 or even higher.

If these drivers want to return to the rates they were paying before the DUI, they will have to spend several years making sure they don’t receive even one speeding ticket; they, most definitely, cannot receive another DUI.
